Kevin D. Batt, Counsel

Kevin Batt combines a decade of experience practicing municipal, land use, environmental and construction law with extensive in-house experience as a former conservation manager developing and implementing energy and environmental programs for the City of Austin, Texas and its municipal electric utility.  His experience includes:

  • Representing the Towns of Concord, Lexington, Acton, and Dover on a host of municipal, land use, environmental and construction law matters;
  • Serving as special counsel to the cities of Cambridge and Attleboro on environmental matters;
  • Representing the Town of Barnstable and the Martha's Vineyard Airport Commission on major airport-related litigation;
  • Representing a major investor-owned utility applying for approval of its restructuring plan as part of the deregulation of electric utilities;
  • Representing public and private-sector clients in cases involving preservation of open space and conservation land, coastal access rights, MEPA review, Title V, and wetlands protection;
  • Advising the government of Puerto Rico on construction litigation involving a major mass transit system in San Juan;
  • Representing public and private clients on affordable housing matters under Chapter 40B, zoning disputes, Chapter 21E contamination cases, property tax abatements, construction claims, bid protests, and routine contract matters;
  • Briefing to the Massachusetts Supreme Judicial Court and Appeals Court novel legal issues involving the regulation of beach-access rights under the common law public trust doctrine, Boston's regulation of taxi cab licenses, and same-sex marriage and civil unions;
  • Clerked for the Honorable Margaret H. Marshall in the 1997-1998 term of the Massachusetts Supreme Judicial Court.
