The number and variety of important appellate cases argued by Anderson & Kreiger lawyers reflect the trust clients place in us when issues of special importance are taken up on appeal. We have argued more than 200 reported cases and submitted countless appellate briefs, from the Appeals Court and Supreme Judicial Court of Massachusetts to U.S. Courts of Appeals and the U.S. Supreme Court. Sometimes we handle appeals that draw on our strengths in constitutional law, land use and environmental law, and airport regulation. But we are often asked to argue one-of-a-kind appeals simply because of our recognized expertise in written and oral advocacy.

For our clients, this experience means we have gained the insight, wisdom and practical judgment that allows us properly to evaluate the prospects for winning on appeal, to identify the best approaches to maximize the chances for success, and to formulate the most persuasive written and oral arguments. Our appellate successes include:

Winning many well-known (and frequently cited) decisions by the Massachusetts Supreme Judicial Court, the U.S. Courts of Appeals and the Massachusetts Appeals Court on constitutional and administrative law, business regulation, environmental law, zoning and land use, airport law, ratemaking and municipal law.

Achieving precedent-setting decisions on issues of first impression under Massachusetts Environmental Policy Act ("MEPA") and the Massachusetts hazardous waste statute (c. 21E).

Representing clients on diverse matters that defy easy categorization, such as the federal constitutionality of regulations protecting the farming industry (argued in the U.S. Supreme Court); the environmental review of a proposed biodefense laboratory and the local regulation of nerve gas testing for the military (both argued in the Supreme Judicial Court); and the protection of visual artists' rights in "site-specific" art (argued in both the Supreme Judicial Court and the First Circuit).
